City of Fort Collins Public Wifi Network Terms of Use#

The City of Fort Collins Public Wifi network (“Public Wifi”) network provides basic Internet access to authorized users only. All users are required to read and accept these Terms of Use Agreement (“Agreement”) for access to the Public Wifi network. Use of this network is monitored for violations of the Agreement, and unlawful activity will be prosecuted to the full extent of the law.

The City of Fort Collins grants guests of its facilities permission to use Public Wifi network as a privilege and may revoke or restrict such access as deemed necessary by its authorized representatives.  As a condition of using the Public Wifi network, you agree to the following:

1. Use this network only at your own risk. In consideration for permission to use the Public Wifi network, you agree, to the maximum extent permitted by Colorado law, to hold harmless the City of Fort Collins and its employees, agents, or officers (collectively, the “City”) from any and all claims arising from or relating to your use of Public Wifi.  By using Public Wifi, you voluntarily assume all risks associated with using this network—including but not limited to data breaches, identity theft, tort liability, and statutory violations.  Any unattended, inactive, or unreasonably long user session may be terminated at the City’s sole discretion. The City is not responsible for any loss or corruption of your data or information.
2. Public Wifi is not private. All wireless communications over the network will be monitored.  Users have no expectation of privacy whatsoever on this network.  Do not transmit or receive information on Public Wifi that you want to keep private, and always assume that the City will monitor all data transmitted or received on the network.
3. Public Wifi is for authorized users only. Unauthorized use or misuse of the Public Wifi network is strictly prohibited.  
4. Public Wifi use is for business, and for limited personal use. The network may be used for incidental personal purposes provided such use is not in violation of law or this Agreement, does not interfere with the operation of the City of Fort Collins, and does not burden the City of Fort Collins with additional costs. 
5. Respect the rights of other users and the integrity of the systems, and observe all relevant laws and regulations. Unauthorized access or unlawful activity will be reported to law enforcement and prosecuted to the full extent of the law. 
6. You are responsible for any consequences to the City arising from or related to your use of Public Wifi. In consideration for permission to use the Public Wifi network, you agree, to the maximum extent permitted by Colorado law, to indemnify the City against any third-party claims, damages or liabilities arising out of or relating to your use of Public Wifi.  This obligation extends to the reimbursement of the City’s attorney’s fees.
7. PUBLIC WIFI IS PROVIDED WITHOUT CHARGE AS A CONVENIENCE ONLY ON AN “AS AVAILABLE,” “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND. You understand and agree that the City makes no representations or warranties regarding availability or quality of the Public Wifi service. There is no guarantee that a wireless connection can be made or maintained, or that service will be uninterrupted or error-free. 
8. As a user of the Public Wifi network, you are solely responsible for the security of your equipment and data. You understand and agree that the City is not responsible for providing help-desk or other technical assistance or support for your use of the Public Wifi network or your software or equipment. Any incidental assistance you may request, if provided, is without charge or other consideration and is accepted at your own risk.
9. You agree that this Agreement is the entire agreement between you and the City regarding the Public Wifi network. There are no other or additional terms, representations, warranties or understandings on this subject matter. 
10. Your relationship with the City. Public Wifi is a convenience provided to guests of City of Fort Collins facilities.  Neither this Agreement or your use of the Public Wifi network creates a partnership, joint venture, employment, or agency relationship between you and the City of Fort Collins.
11. This Agreement and your use of the Public Wifi network will be decided in Colorado and according to Colorado Law, without regard to conflict-of-law principles. Any dispute or legal proceeding arising from or related to this Agreement or your use of Public Wifi will be venued in the Eighth Judicial District of Colorado or the United States District Court for the District of Colorado.

By using City's Public Wifi, I acknowledge I have read, and agree to, all terms of this Agreement.
